North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his/her employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee were exposed to a fall hazard. a)At the facility: one employee was observed climbing up a ladder located on the back to gain access to the top of the trailer, the trailer had a fall height of approximately 13 feet, but the employee was wearing no personal fall protection nor was there any type of fall protection system installed. b)At the facility: one employee was observed walking on top of the solid waste on the top of a trailer, with a fall height of approximately 13 feet, he was in closed proximity to the unprotected side of the trailer, but the employee was wearing no personal fall protection nor was there any type of fall protection system installed. c)At the facility: one employee was observed standing on a 'cat walk' approximately 10 inches wide, located on the back of a truck trailer, with a fall height of approximately 10 feet, to tie off the straps of a tarp; but he was wearing no personal fall protection nor was there any type of fall protection system installed Two feasible and acceptable methods of abatement are: 1. For the employer to provide mechanical or automatic tarpaulin-covering devices that can be operated from the ground which will prevent employees to be exposed to the fall hazard. 2.For the employer to provide flat bed truck rack or tarpauling system that provides an elevated working platform protected by a guar rail system.ed
