North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a crushed by hazard: a)jobsite, dock - employee was operating a Toyota electric forklift, SN 7FBCHU25, while not a wearing seatbelt. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct these hazards is to require the use of seatbelts by all operators. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck by or crushed in between hazard: a)facility, loading dock - no program had been developed to protect forklift operators during the loading of tractor trailers from unexpected movement, in any direction of vehicles. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard is to develop and implement a program to ensure any movement by tractor trailers only be made under positive control by United States Cold Storage. This program may include items such as vehicle operators and key control and specific rules for temporary and long term parking.y
