North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)receiving - Crown motorized hand truck, model 400 PW-4-14, serial #W92085, capacity 4000 pounds, was observed to have malfunctioning brakes when operated by maintenance supervisor at time of inspection. Reference:ASME/ANSI B56.1-1993 (American National Standard Powered and Non-powered Industrial Trucks - SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS. ASME/ANSI B56.1-1993 (Section 5.5.1.1, page 13): "If the truck is found to be in need of repair or in any way unsafe, or contributes to an unsafe condition, the matter shall be reported immediately to the user's designated authority, and the truck shall not be operated until it has been restored to safe operating condition." One feasible and acceptable method of abatement is for the employer to have the lift inspected daily before each shift so that any unsafe matter can be reported to user's designated authority.
