North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with working in a hot environment: a)facility - where the employer did not develop a heat stress management program for employees who were exposed to a heat index of 103 degrees Fahrenheit or greater, to help them recognize and avoid heat stress related illnesses; and hazards associated with working in a hot environment. One feasible and acceptable abatement method, among others, to correct this hazard is to develop a heat stress management program to include elements such as the following: a)Engineering controls. b)Work practices. c)Acclimatization d)Personal protective equipment e)Employee education and training. f)Worker monitoring program Reference: American Conference of Governmental Industrial Hygienists. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: a)facility, yard - where forklift operators did not wear seatbelts that were provided. Reference: American Society of Mechanical Engineers (AMSE) Safety Standard for Low Lift and High Lift Trucks. ASME/ANSI B56.1-1993 section 5.3.19. Feasible abatement methods, among others, to correct this hazard are, but not limited to: a)Require and enforce the wearing of seatbelts while operating a forklift. b)re-train all forklift operators in the safe operating conditions of forklifts.
