North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to a struck or crushed by hazard: a)facility, lab area - where employees operated a liquid propane-powered Allis-Chalmers lift truck (Model: FT20-24 Serial: 65674000) equipped with a roll over protection system (ROPS) and was not provided with a seatbelt for operator use. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a seat belt on the forklift and train employees on seatbelt use while operating the forklift.
