Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not properly trained in the hazards associated with operating a nail gun to make and close crates. A worker was struck by a nail in the chest requiring surgery: Methods of abatement are: 1) Ensure workers read the operating manuals for the nail guns. 2) Ensure workers use ladders or portable stairs when closing the tops of tall crates in order to be able to shoot down and away from themselves. 3) Ensure workers stand on flat surfaces while using the nail guns to close crates to prevent falling as they are shooting nails. 4) Ensure workers do not point the nail guns towards their body.
