Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and crushed-by hazards: a) On or about 3/20/12 - West end of Debarker Area, the Case Corporation loader/ landscaper, Model# 570LXT, VIN# JJG0225802, was operated without a seat belt. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that seat belts are provided and utilized, as stated in ASME B56.1b-2003, Safety Standard for Low Lift and High lift Trucks, Section 7.41, Operator Restraint Systems.t
