Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:
(a)Date of Violation:On or About 04/10/12
Location:East Side Parking Lot near Basketball Court
Condition:An employee was exposed to the hazards of being thrown from a
moving utility
vehicle while riding in the cargo box and was not trained in accordance
with the
operation's manual which states that extra riders can fall off and be
seriously injured
and killed.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to follow the
John Deere's operator's manual instructions on page 15 that states:
CAUTION: Avoid injury! Seating is
provided for the operator and one passenger. Do not allow riders in the
cargo box or on the tailgate. Extra
riders can fall off and be seriously injured and killed.
