North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)on the site, fall protection measures were not utilized by employees accessing flatbed trailers, as on March 27, 2012, an employee was standing on the back of a flatbed trailer when he fell 52" to the ground and struck his head on the asphalt. Among other methods, one feasible and acceptable method to abate the hazard is to work from the ground.
