Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): The employer did not furnish each of his employees employment and a place of employment which are free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees. Employees in the warehouse next to the office are exposed to the hazard of being thrown from the forklift and being crushed in a turnover accident while operating a powered industrial truck without a serviceable seatbelt. Thus, employees are working in an environment that is not free of recognized hazards as required by ASME/ANSI B56.1a-1989 and ASME B56.1-1993 Safety Standards for Low Lift and High Lift Trucks. One feasible and acceptable abatement method includes but is not limited to installation of a serviceable seatbelt. Date Corrected: Describe Corrective Action:
