40.1-50.1(a) of the Code of Virginia: The employer, Little's Construction, LLC , did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employees were working under the picnic shelter with the 14 support posts set on concrete footers in 2 1/2 inches of dirt and wet concrete, with no anchor point, exposing employees to serious injury or death, from collapse of the structure. On September 6, 2012, at the construction site of the Shenandoah Valley Academy's picnic shelter at 234 W. Lee Hwy. in New Market, Virginia, two workers were screeding concrete under the picnic shelter as a concrete truck delivered concrete for the pad. The owner of Little's Construction, LLC was acting as a ground guide directing the driver as he backed the truck into position to disburse the concrete. The ground guide slipped on the wet ground and the concrete chute struck the northeast corner post causing the structure to collapse. The two worker(s) were briefly trapped underneath the collapsed shelter. Significant injuries occurred. One feasible and acceptable method, among other methods, to correct this hazard would be to comply with the Engineer's approved building plans, and/or Shenandoah County Building Code Specifications, which required each support post to be buried 3-feet in the ground or secured by an anchor point.
