North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)Facility - where a 500 sq ft section of a wood framed roof adjacent to the front entrance of the building was observed with damage from water to the point where portions of the roof had collapsed. ABATEMENT NOTE: The employer can reasonably abate the hazard by contracting with a certified engineer to develop a plan to replace the damaged roof, and then to execute the plan. An immediate abatement measure would be to remove employees from the dangerous area and close off that entrance to the building.
