North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushed by hazards: a)Intersection of I-95, Exit 119 & US 264, Exit 38 - where the employer did not ensure the operator wore the installed seatbelt on the NEW HOLLAND TL100A, Tractor #27 which was equipped with a roll over protection system (ROPS). Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have employees fasten the installed seat belt when operating equipment. Or, in the alternative: 29 CFR 1910.132(d)(1)(i): The employer assessed the workplace, determined that hazards were present, or were likely to be present, which necessitated the use of personal protection equipment (PPE) and did not have each employee use the types of PPE that would protect the affected employee from the hazards identified in the hazard assessment: a)Intersection of I-95, Exit 119 & US 264, Exit 38 - where the employer did not ensure the operator wore the installed seatbelt on the NEW HOLLAND TL100A, Tractor #27 which was equipped with a roll over protection system (ROPS). Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have employees fasten the installed seat belt when operating equipment.
