North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a baler door. a) Mote press Model C-30 Serial # 0809-246 operated in a shed located at 120 Co-Op Lane, Garysburg, NC- The employer, GCI, repaired and modified a mote press outside of the recommendations of the manufacturer, International Baler Corporation (IBC), when it allowed an employee to weld a broken cylinder rod and weld a metal loop to the door frame of the baler to hold a chain with a hook, after the cylinder rod broke and the mote press door opened unexpectedly and with high pressure, injuring an operator. Abatement Notice: One feasible means of abatement is to follow the operator manual and follow the manufacturer recommendations regarding maintenance/check, reconstruction or modification of the equipment.on
