North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that an employee was exposed to struck by and fall hazards:
a)  Baling operation located at 1172 Webb Road, Dunn, NC 28334 - where one
employee was standing on top
of a stack of tobacco, inside of a Transplant Systems tobacco baler, the
hydraulic system was not turned off or
the controls locked out to prevent inadvertent engagement of the plunger
mast. In addition, the employee was
not protected from the hazard of falling approximately 6 ft. to the ground
below.
Abatement Notice: One feasible and acceptable means of abatement is to
follow all manufacturer and industry
accepted safe tobacco baler work practices. Do not allow any employee to
stand inside of a baler unless it is
effectively locked out to prevent inadvertent actuation.
