North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Liberty Commons - where an employee was using an eight foot, fiberglass step-ladder to gain access to the attic, utilizing the top rung of the ladder. ABATEMENT NOTE: a)One acceptable abatement method to correct this hazard is to use an extension ladder to gain access to the attic. Reference a)Hazards are recognized and addressed in ANSI A 14.5-1992 paragraph 9.3.2; "The user shall climb or work with the body near the middle of the step or rung. The user shall not step or stand higher than the step or rung indicated on the label marking the highest standing level of a ladder. The user shall not step or stand on: (1) A ladder top cap and the top step of a step or trestle ladder, or the bucket or pail shelf of a self-supporting ladder. (2) The rear braces of a self-supporting ladder unless they are designed and recommended for the purpose by the manufacturer. (3) The top step of th extension section of an extension trestle ladder. (4) The top cap or top step of a combination ladder when it is used as a self-supporting ladder."porting
