employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to: caught in between hazards when the operator of
a Caterpillar TH63 Telehandler
left the operators position while a load was still raised above the ground.
a)job site - the employer who was operating a Caterpillar TH63 Telehandler
was outside the cab
of the machine while the forks were raised with a load of plywood.  This
load was
approximately 3 feet above the surface of a 4:12 roof with a 12 foot eve.
ABATEMENT NOTE:
1)Among other methods, one feasible and acceptable abatement method to
correct these hazards is
to lower the load-engaging means (forks) fully to the ground before
exiting the operator's
position.
