North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his/her employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee were exposed to a crushed by hazard. a)Mechanic Shop: the employer did not maintain or implement periodic inspection for a Stertil Koni Mobile Column hydraulic automotive lift, model# ST-1060FC, serial# TW139300, 4 columns with a 13,000lbs capacity each, which was available for employees use on their day to day operation for a fleet maintenance. Reference:ANSI/ALI ALOIM:2008 (American National Standards Institute/Automotive Lift Institute) - Standard for Automotive Lifts - SAFETY REQUIREMENTS FOR OPERATION, INSPECTION AND MAINTENANCE. ANSI/ALI ALOIM:2008 (Section 5, page 7 - Periodic Qualified Inspection): "The owner or employer shall establish a periodic inspection procedure in accordance wiht the recommendations of the lift manufacturer in order to ensure reliability and allow continued safe operation of the lift..." One feasible and acceptable method of abatement is for the employer to have the lift inspected by a manufacturer representative or a qualified person at least once a year.
