North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his/her employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employee were exposed to a burn hazard. a)At the facility: in or about September 6, 2016, an employee tripped over one of the three (3) 60 qt grease drain aluminum pots, with lid and caster base, model no. COMIR60LC, which contained hot cooking oil at approximately 300 degrees Fahrenheit, and received serious skin burns, the pots was placed approximately 6 inches away from the swing radios of the exit door on the employees' pathway. b)At the facility: the latches on the lid a 60 qt grease drain aluminum pots, with lid and caster base, model no. COMIR60LC, use by the employees to drain and transport approximately 4 gallons of hot cooking oil, approximately 300 degrees Fahrenheit, did not close properly, but the pot was not taken out of service. Two feasible and acceptable methods of abatement are: 1. For the employer designate a safe and secure location in which to place the hot grease drain pots. The place should be away from the exit door and barricaded. 2.For the employer to implement a periodic inspection procedure to determine the condition of the grease drain pots. When inspected if any damage compromising the safely use of the equipment is found, then the grease drain pot must be replaced.
