Labor and Employment Article, Section 5-104(a): The employer did not
furnish employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to employees:
(a)Date of Violation:09/28/12
Location:Middle of the Back Yard at 19 Dixie Drive, Towson, Maryland
Condition:The arborist trainee climber/cutter was positioned in a large
cherry tree within 10 feet
of overhead energized electric lines without supervision from a qualified
arborist.

Among other methods, one feasible and acceptable means of abatement to
correct this hazard would be to have
the arborist trainee cutting in the tree be under the direct on site
supervision of a qualified arborist when they
must approach closer than 10 feet of an energized conductor in excess of
750 volts.

with the possibility that
the branches/limbs could contact the energized lines without a second
qualified line

Among other methods, one feasible and acceptable means of abatement to
correct this hazard would be to have
a second qualified arborist or trainee on site to afford constant verbal
contact when branches/limbs are being
felled which
cannot be first cut to sufficiently clear the electrical conductors.
