North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment which were free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees in that employees were
exposed to: fire
hazards:
a)Field Operations- on or about June 14, 2012 one employee was burned when
the
2006 Autocar/Labrie side loader garbage truck he was operating caught fire
as a
result of a ruptured hydraulic hose spraying hydraulic fluid on the hot
turbo
which was located below and to the rear of the cab that he occupied.  The
employer failed to take feasible steps to prevent the fire after two
similar fires
occurred previously on 12/13/11 and 9/6/11.
ABATEMENT NOTE: Among other methods, feasible and acceptable abatement
methods to correct the hazard include:
1) Install hydraulic hoses that are equipped with the protective sheathe.
2) Install a shield over the turbo/exhaust to protect from
flammable/combustible
materials.
3) Conduct more frequent inspections of hydraulic hoses.lic
