Section 31-370(a) of the Connecticut Occupational Safety and Health Act:
The employer did
not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a struck by hazard when assigned to perform
mark-out of utility(ies)
without using traffic control devices, other personnel to perform
flagging/spotting, or or other
traffic control methods. Among other methods feasible and acceptable to
correct this hazard is
to: 1) modify the employer's written policy to include requiring a flagger
or spotter; 2) ensure
that employees are trained and understand the duties of flagging/spotting;
3) ensure that
employees utilize their assigned work vehicles equipped with amber colored
flashing lights to
alert other vehicle operators of the worker(s) presence in or near the
roadway; and/or 4)
requiring employees to post DOT-approved signage to the rear of their work
vehicle to alert
motorists of workers being in/near the roadway.

(A)Intersection of of New Norwalk Road and East Avenue, New Canaan, CT.
(1)An employee was struck and killed by a motorist while the employee was
marking out sewer lines without using available traffic control methods.
