North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a)warehouse, employees were working on the blender platform which was accessed by stepping on the top plate of an 6 foot A frame fiberglass ladder which exposed the employee to a 5.75 foot fall to the concrete below. Among other methods, one feasible method to eliminate this hazard is to utilize a taller ladder and comply with the manufacturer's instructions.s
