North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death of serious physical harm to
employees in that employees were exposed to the potential hazard of
struck-by injuries from dropped loads
resulting from a malfunctioning manual chain hoist:
a)Dotson Building - - Sandblasting Room:  The employer failed to develop
and implement a
process to ensure frequent and periodic inspections of the overhead manual
chain hoists.
Among other methods, one applicable and feasible method to correct this
hazard is to implement a
schedule of frequent and periodic inspections of the overhead manual chain
hoists that complies with the
requirements outlined in ANSI B30.16-2003 "Overhead Hoists (Underhung);
Chapter 16-2: Inspection,
Testing, and Maintenance; Section 16-2.1.1(b)(1) Frequent Inspections,
Section 16-2.1.1(b)(12) Periodic

to an over-loaded manual chain hoist:
a)Dotson Building - - Sandblasting Room:  The employer failed to ensure
the rated load capacity
markings on two overhead CM 2-ton manual chain hoists were legible from
the floor by
employees operating the chain hoists.
Among other methods, one applicable and feasible method to correct this
hazard is to apply and maintain
clear markings on the casings of the overhead chain hoists or the hoists'
load blocks which display the
rated load capacity of the hoists and are legible from the floor.e

a)Facility - - Dotson Building - - Sandblasting Room:  The employer failed
to ensure labels
displaying instructions detailing operational warnings were affixed to two
overhead CM manual
chain hoists or their load blocks.
Among other methods, one applicable and feasible method to correct this
hazard is to obtain and affix to
the chain hoist or its' load block a label displaying the operational
warnings contained in ANSI B30.16-2003 "Overhead Hoists (Underhung);
Chapter 16-1 - Marking, Construction, and Installation; Section
16-1.1.4 - Warnings.
