North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential hazard of struck-by injuries from dropped loads resulting from a malfunctioning electrically-powered overhead chain hoist: a)Facility - Snack Prep Room: The employer failed to develop and implement a process to ensure frequent and periodic inspections of two [2] electrically-powered Harrington chain hoists operated in the Room. Among other methods, one applicable and feasible method to correct this hazard is to implement a schedule of frequent and periodic inspections of the overhead electrically-powered chain hoists that complies with the requirements outlined in ANSI B30.16-2003 "Overhead Hoists (Underhung)"; Chapter 16-2: Inspection, Testing, and Maintenance; Section 16-2.1.2 Frequent Inspections; Section 16-2.1.3 Periodic Inspections, and Chapter 16-2 Table 2.ble
