North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an operator was exposed to a struck-by / tipping hazard by not following manufacturers' recommendations: a.)Jobsite in Luther Ridge Community, 1185 Lower Laurel Drive, Arden NC 28704 - The operator did not follow manufacturers' recommendations per the hydraulic winch system on the Carlton 1712 - 12 inch disk style brush chipper and the Ditch Witch SK650 - platform, rubber track mini skid steer in order to prevent the mini skid steer from tipping over onto its side while the winch on the chipper was pulling a maple log out of the work area. Abatement Note: Feasible and acceptable abatement methods, among others, to correct this hazard is to follow the recommendations of: 1.)The operator's manual for the Ditch Witch SK650 - platform, rubber track mini skid steer. 2.)The owner's manual for the winch operations for the Carlton 1712 - 12 inch disk style brush chipper. 3.)The American National Standard Institute (ANSI) Z133.1-2006, Safety Requirements for Arboricultural Operations.
