North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard: a)facility, warehouse - employee exposed to a propane Clark forklift, Model C30B Serial Number 4662081, with a pallet built box 33 inches wide and 43 inches high that was not secured to the forks while employees were using the box to install overhead flourescent lights 20 feet high. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is that the employer contact the forklift manufacturer and get a factory attachment for lifting employees.
