Vermont Statute, Title 21 Labor : Chapter 3. Safety : 21 V.S.A. ' 223. Duties and Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his or her employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or significant physical harm to his or her employees, in that, the employees were exposed to strike-by hazard(s) from unsecured, freestanding bottles of compressed gas that could be reasonably anticipated to fall over and release the pressurized contents contained within where the pressure breach from these bottle(s) could create enough propulsive force on these bottles to strike & injure employee(s). Location: New England Quality Services Inc., d.b.a. Earth Waste & Metal, 3046 Case Street, VT Rte.116, Middlebury Vermont Violation: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or physical harm to employees, in that, employees were exposed to the hazard of being struck- by unsecured compressed gas cylinders: On or about January 22, 2013, in the New England Quality Services Inc., d.b.a. Earth Waste & Metal facility at 3046 Case Street, VT Rte.116, Middlebury Vermont employees were exposed to a struck-by hazard due to the presence of three (3) unsecured compressed gas cylinders in their immediate work area. The employer did not ensure that the free standing, pressurized, gas cylinders were secured so that the cylinders would not tip over to strike 1) employees or; 2) other objects where the bottle cylinders could be damaged and consequently be catapulted into an employee(s) by self propulsion caused by leaking pressurized gases. Among other procedures, one feasible and acceptable abatement method for correcting this hazard is to comply with the Compressed Gas Association pamphlet, Safe Handling of Compressed Gas Cylinders, CGA P-1-2000 paragraph 3.7.4 All compress gas cylinders in service or storage at user locations shall be secured to prevent falling or rolling.
