Vermont Statute, Title 21 Labor : Chapter 3. Safety : 21 V.S.A. ' 223. Duties and Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his or her employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or significant physical harm to his or her employees, in that, the employees were exposed to the hazard of inadvertent mixing of incompatible chemicals that would produce exothremic chemical reactions that release hazardous fluorine gas and/or chlorine gas and/or elevated heat-of-reactions. Location: The laundry room at Pine Knoll Nursing Home Inc., 601 Red Village Road, Lyndonville Vermont. Violation: The employer did not furnish to each of his/her employees a place of employment which was free from recognized hazards that were causing or likely to cause death or physical harm to employees, in that, employees were exposed to the hazard of strong exothermic chemical reactions that include(s) the offgassing of hazardous halogenated gases where five (5)-gallon, plastic containers of Hydrofluorosilicic Acid (halogenated acid) and Sodium Hypochlorite (halogenated alkali) and Sodium Hydroxide (alkali): On or about May 01, 2013, in the laundry room of Pine Knoll Nursing Home Inc. facility at 601 Red Village Road, Lyndonville Vermont employees were exposed to a chemical inhalation hazard and a burn hazard due to the presence of three (3) unsecured incompatible chemicals being dispensed immediately next to each other in the employees' immediate work area. Among other methods, one feasible and acceptable abatement method for correcting this hazard is to physically separate the acids from the bases and to secure these five-gallon buckets inside containment pans or troughs. This administrative change would eliminate the chance of inadverently mixing incompatible materials caused by 1) broken or accidentally opened bung holes in the containers and/or; 2) broken service tubing exiting the containers and/or; 3) incorrectly emplaced service tubing filled with an incompatible material and/or 4) a spill or spatter accident.
