North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to struck by hazards:
a)Amusement train track - On or about 11/16/12 an employee was blowing
leaves from the train tracks
was struck by a 16,900 lb amusement train/cars traveling approximately 4-5
mph, the employee was
not provided with task specific training.  Training must include methods
of communicating work
activities adjacent to the tracks with the train operator.
Abatement note:  Among other methods, one applicable and feasible method
would be to provide
verbal and hands on training to the employees prior to being assigned any
task requiring working on
or near the train tracks.
