North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a struck by hazard a)shop area - employer did not maintain or implement periodic inspections for BendPak surface mounted 2 post lift to ensure that lift locks engage and are operational in all the intended points for employees use in their day to day operations. Reference:ANSI/ALI ALOIM:2008 (Section 5.6.2.16, page 9): "Operate the lift through full cycle and check the operation of the positive stop. Check to see if the lift locks engage in the fully extended position. On lifts employing continuous locking systems, check to ensure that the lift locks are operational and engage in all the intended points. Also check to confirm proper operation of the lock release mechanisms and the lock reset devices. Report improper function, excessive wear or damage." One feasible and acceptable method of abatement is for the employer to have the lift inspected daily before each shift so that any unsafe matter can be reported to user's designated authority.
