North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)facility, rotary dryers - where employees worked adjacent to the two rotary-style wood shaving dryers that did not have automatic spark detection and extinguishing systems installed between the dryer drum and downstream material-handling equipment, such as the cyclones and fuel bins. Reference: National Fire Protection Agency (NFPA) 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities (1998), paragraph 11-3.3.3, "Thermal fire detectors shall be provided downstream from the dryers, normally in the ductwork at the dryer exit."

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)facility, dust collection systems - where employees worked adjacent to the two wood dust collection systems that were not provided with deflagration vents on the ductwork and cyclones. Reference: National Fire Protection Agency (NFPA) 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities (1998), paragraph 8-3.5 and 8-3.6. b)facility, wood chip storage bin - for employees working adjacent to the wood chip storage bin that was not provided with deflagration vents. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to potential fire and explosion hazards: a)facility, bagging area - where the employer did not ensure the use of compressed air frequently enough to clean the beams, walls, floor, and equipment surfaces around the bagging machine (Verville VP-400) to prevent the hazardous concentration of dust in suspension where wood dust was allowed to accumulate up to nine inches in depth in some areas. ABATEMENT NOTE: The use of compressed air shall be permitted only where the following requirements are met: 1.Area and equipment shall be vacuumed approved for a Class II, Division I, Group G, in accordance with Article 502, NFPA 70, National Electric Code (2011) prior to blow down. 2.Electrical equipment not suitable for Class II locations and other sources of ignition shall be shut down and allowed to cool or removed from the area. 3.Only low-pressure steam or compressed air, not exceeding a gauge pressure of 15 p.s.i. shall be used. 4.No hot surfaces of flames capable of igniting a dust cloud or layer shall exist in the area. Reference: National Fire Protection Agency (NFPA) 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities (2007), Chapter 11.2.1.1
