North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)Shipping/Receiving Yard - where the "Komatsu" model #FG25, LP type forklift did not have a functioning back-up alarm and was being used to transport empty, wet, wooden storage crates outside for the purpose of drying. b)Shipping/Receiving Yard - where the "Komatsu" model #FG25, LP type forklift did not have a functioning operator-controlled horn and was being used to transport empty, wet, wooden storage crates outside for the purpose of drying. Abatement Note: One feasible means of abatement would to install a working back-up alarm and a functioning operator controlled horn. Also, ensure that the alarm and horn functions are checked as part of the pre-shift inspection of the lift.
