North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to corrosive chemicals: a)work site - where employees used the backpack sprayer (Piston Pump, 4.2 gallon, ASC Agri Supply, Model NS-16, Item # 69028) or the hand held sprayer (Hand Pump Sprayer, 2.9 gallon, ASC Agri Supply, Model NS-8, Item # 63024) to spray an unapproved chemical, such as Grease Buster which is a corrosive and contains Sodium Hydroxide (pH 13.2) to degrease concrete at restaurants such as, but not limited to, Bojangles. ABATEMENT NOTE: a)One acceptable abatement method to correct this hazard is to supply a sprayer which is approved to handle caustic and corrosive solutions such as Solo 462, Commercial Duty Acid Sprayer. Reference a)Hazards are recognized and addressed in the ASC Agri Supply owner's manual on page 2, under the section "Maintenance and safety"; "7. The sprayer is designed for spraying most of pesticides, herbicides, cleaning agents and other chemicals. But do not spray caustic or corrosive chemicals." Also addressed in the ASC Agri Supply owner's manual for the hand held sprayer on page 3, under the section "Warning/Advertencia"; "This sprayer is designed and manufactured solely for the purpose of applying agricultural chemicals to plants. Under no circumstances may it be used for any other purposes."ces
