North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)Facility - outside refrigeration plant, upper level, overhead hoist located above compressor #1 was not marked with manufacturer's identification information. (Reference: ASME B30.16-2003, 16-1.1.3). b)Facility - outside refrigeration plant, upper level, overhead hoist located above compressor #1 did not have affixed to the hoist, load block, or controls, a label or labels displaying information concerning operating procedures. (Reference: ASME B30.16-2003, 16-1.1.4). c)Facility - outside refrigeration plant, upper level, overhead hoist located above compressor #1 was not furnished an instructional manual.
