North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazard: a)Facility - Body shop garage area where the BenchRack 5000 left approach ramp was damaged causing the ramp to raise up out of the bench bracket (Reference: Safety section, page B7 of the BenchRack 5000 Instruction Manual). b)Facility - Body shop garage area where the BenchRack 5000 left approach ramp had two one inch long stress cracks along the upper portion of the ramp (Reference: Safety section, page B7 of the BenchRack 5000 Instruction Manual). c)Facility - Body shop garage area where the BenchRack 5000 mechanical locking device did not operate according to manufacturer's guidelines and personnel working with the equipment could not determine if the mechanical lock was in place before working under BenchRack system (Reference: Lift section, page H3-3 of the BenchRack Instruction Manual).
