North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by falling heavy load: a)beam shop and grinder shop-hooks used to lift as much as 6 tons, that has been equipped with latches, were being operated with the latches removed. (re: para 10-1.4.6 (a)(5)) One feasible means of abatement is to ensure all of the slings equipped with hooks equipped with latches, be inspected and if missing replace the hooks or reinstall the latches.
