North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to eye contamination possible eye damage. : a)brew area-eye wash fountain where caustics are used to clean equipment, was not tested regularly and when the lever was activated, ran rusty water and not tested on a regular basis.(ref para 7.5.1 ANSI Z358.1-1998)(para 5.5.2 ANSI Z358.1-2004) One possible means to abate the condition is to assign a supervisor to check and inspect the eyewash station and shower weekly.
