North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck or crushed by hazard: a)compound - where an employee operated a diesel-powered Hyster rough terrain forklift truck equipped with roll over protection system (ROPS) and was not provided with a seatbelt for operator use. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a seat belt on the rough terrain forklift and train employees on seatbelt use while operating the rough terrain forklift truck.
