North Carolina General Statute 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)facility - where an employee used a World Rack 4000 frame machine beyond its 4,000 pound capacity causing physical deformations in the structural integrity of the piece of equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the piece of equipment, or purchase a frame machine with a higher rated capacity.
