North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by vehicular traffic: a) Jobsite, vicinity of 668 Hendersonville Road, Asheville, NC - Employees were exposed to vehicular traffic during the installation of fiber optic cable on existing utility poles without having an established a work zone in accordance with the US Department of Transportation Manual on Uniform Traffic Control Devices (MUTCD) or applicable state and local laws and regulations. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to establish a Roadway Work Zone on the 'traveled way' prior to beginning work on highways including right-of-ways. according to directives established in Part 6, Temporary Traffic Control, Table 6H-1 / Index to Typical Applications of the MUTCD, 2009 Edition.
