Nevada Revised Statute 618.375(1): Duties of employers. Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees.
The employer failed to ensure that employees utilized proper fall
protection while
operating an aerial boom lift, as follows:
On January 31, 2013, at Advanced Lighting Services, Inc jobsite located at
1281
West Warm Springs Road, Henderson, NV 89014, employees were working in
a vehicle mounted aerial boom lift while replacing light bulbs on the
parking lot
street lights. The employee was working approximately twenty (20) feet
above the
ground and was not wearing any personal fall arrest equipment.

- Paragraph 9.3.1 (Responsibility of users) General Training: Only
personnel who have received general instructions regarding the inspection,
application and operation of aerial devices, including recognition and
avoidance of hazards associated with their operation, shall include, but
not
necessarily be limited to, the following issues and requirements: (12)
Proper use of personal fall protection equipment. Fall protection systems
criteria and practices are covered in 29 CFR 1926.502.

operation of the aerial device all platform occupants shall use appropriate
fall protection connected to the aerial device anchorage(s).

One feasible and acceptable means of abatement is to ensure that all
employees working
in an aerial lift wear the proper fall protection, including their safety
harness and
lanyard.
