Nevada Revised Statute 618.375(1): Duties of employers. Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees.
The employer failed to ensure that employees were wearing their personal
fall protection while
working on the platform of a self powered boom lift, as follows:
On January 31, 2013, at the Crazy Horse III Gentleman's Club located at
3525 West
Russell Road, Las Vegas, Nevada 89118. Employees were working on parking
light
number four (4.) The employees were working in a self powered boom lift,
JLG
Industries model # 600S serial # 0300167617. Employees were working at
heights of
approximately twenty (20) feet and were not wearing the proper fall
protection as
required by ANSI/SIA A92.5 and the owners manual for Model 600S. Employees
were
exposed to possible serious injury from a fall hazard.

- Paragraph 7.7 (Users) Before Operation: Before authorizing an operator to
operate an aerial platform the user shall ensure that the operator has:
(e) Been
provided with approved fall protection devices and other safety gear for
fall
personnel in the platform.
- Paragraph 8.8 (Operators) During operation: The aerial platform shall be
used
in accordance with this standard. The operator shall ensure the following
before
each elevation of the platform: (g) Ensure all personnel in the platform
are
wearing fall protection devices and other safety gear as required at all
times.

0300167617)
Page 1-3: Operation: GENERAL. During operation, occupants in the platform
must wear a full body harness with a lanyard attached to an authorized
lan-yard
anchorage point. Attach only one (1) lanyard per lan-yard anchorage point.
Page 2-1: Operators Training. Operator training must cover: (4) Use of
approved
fall protection device.
One feasible and acceptable means of abatement is to ensure that all
employees working
in an aerial lift wear the proper fall protection, including their safety
harness and
lanyard.
