Duties of employers.
Every employer shall furnish employment and a place of employment which
are free from
recognized hazards that are causing or are likely to cause death or
serious physical harm to his
or her employees.
At Liberty Duct, LLC, sheet metal fabrication activities, employees were
operating
hydraulic press brakes (#1 make: Primeline, model no: 01/2004, serial no:
7463, #2
make: U.S. Industrial Machinery, model no: US15513, serial no: W2007-231)
and the
employer did not ensure they were protected from recognized serious
hazards, i.e.,
hand/finger amputation/crushing injuries. While fabricating made-to-order
(custom-made)
piece parts for HVAC (heating ventilation/air-conditioning) ducts,
physical guards and
physical devices were not feasible methods to protect press brake
operators from the
point of operation.  This is due to the multiple bends/brakes that are
applied
to a single
piece of sheet metal.  The employer did not ensure the employees were
protected by any
other means.

Guarding of Power Press Brakes:
a. Demonstrate that physical barriers and physical devices are not
feasible to
guard the power press brake point of operation.
b. Demonstrate that power press brake point of operation guarding by
maintaining
a safe distance is limited to one-time only fabrication of made-to-order
or custom-
made piece-parts.
c. Have a safety program which includes safe work procedures, training, and
supervision to ensure that work is performed using "safe distance"
alternative
measures.
d. Have a workplace history of operating power press brakes safely by
maintaining a safe distance from the point operation.
One feasible means of abatement would be to implement the procedures and
methods
provided for in Compliance Directive (CPL) 02-01-025.

At Liberty Duct, LLC, sheet metal fabrication activities, employees were
exposed to
recognized serious hazards associated with press brake operations, i.e.,
hand/finger
amputation/crushing injuries in two instances.
1. Employees operated hydraulic press brakes (make: Primeline, model no:
01/2004, serial no: 7463, make: U.S. Industrial Machinery, model no:
US15513,
serial no: W2007-231) that were being cared for, inspected, and maintained
by
personnel that lacked the training to do so.  This exposed the employees to
possible serious injuries due to press brakes that could potentially
function
incorrectly.
2. Press brake operators were engaged in die-setting activities and had
not been
trained to do so, exposing them to possible serious injuries.

4.2.4 Employer's Responsibility. The employer shall be responsible for the
training of personnel caring for, inspecting, maintaining and operating
hydraulic
press production systems to ensure their competence.
9.2.4 Die-setter training. Die setters shall be instructed in the proper
procedures
for selecting, inspecting, installing and removing dies for the operations.
One feasible means of abatement is to follow the requirements of ANSI
B11.2-1995.
