Nevada Revised Statute 618.375(1): Duties of employers.  Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees.
The employer did not furnish a place of employment which are free from
recognized
hazards that are causing or likely to cause death or serious physical harm
to employees.
At the 24 Hour Fitness Center located at 2556 Wigwam Parkway, Henderson,
Nevada,
an employee was exposed to falls of approximately 8 feet to the deck below
while
engaged in fire sprinkler inspection and replacement activities. The
employee was
climbing on the top step and/or top plate of a reinforced plastic 12 foot
red Werner
stepladder.
ANSI A-14.5-(2000), Section 9.3.2 states in part, "The user shall not step
or stand on:"
ANSI A-14.5-(2000), Section 9.3.2(1) states in part, "A ladder top cap and
the top step
of a step or trestle ladder..."
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD INCLUDES USING A LADDER OF
SUFFICIENT HEIGHT WHICH DOES NOT REQUIRE AN EMPLOYEE TO STEP OR
STAND ON THE TOP STEP OF A STEP LADDER AS SPECIFIED IN THE AMERICAN
NATIONAL STANDARD FOR LADDERS, PORTABLE REINFORCED PLASTIC
LADDERS SAFETY REQUIREMENTS.
