Nevada Revised Statute 618.375(1): Duties of employers. Every employer
shall furnish
employment and a place of employment which are free from recognized
hazards that are
causing or are likely to cause death or serious physical harm to his or
her employees.
At the Charleston/Carquest Auto Parts (CAP) Warehouse, located at 3108
Losee
Road, North Las Vegas, NV, 89030, employees were exposed to serious
crushing
hazards while using steel storage racks that were not labeled for weight,
steel storage
racks that had damaged legs that were buckling, shelves that were
partially corroded,
and shelves that were sagging, an indication of excessive loads. Employees
were
tasked with storage operations, and their use of these shelves exposed
them to injuries
including blunt force trauma and death if the damaged racks were to
collapse or if
product fell from the shelves.

1. In the warehouse section of the business, none of the steel storage
racks had
plaques explaining the weight limits. ANSI standard MH16.1 Paragraph
1.4.2 states the following:
The owner is responsible for displaying in one or more conspicuous
locations a
permanent plaque(s). Each plaque shall have an area of not less than 50
square
inches. Plaques shall show in clear, legible print (a) the maximum
permissible
unit load and/or maximum uniformly distributed load per level, (b) the
average
unit load (PL average, see Section 2.6.3) if applicable and (c) maximum
total
load per bay. The unit load is usually a single pallet or container and its
contents mechanically transported. Storage levels having multiple stacking
of
unit loads shall be so identified. It is the responsibility of the owner
to ensure
that the rack system is not altered so that the plaque information is
invalidated.
2. In the warehouse section of the business, one (1) steel storage rack had
damaged legs that were buckling. ANSI standard MH16.1 Paragraph 1.4.9
states the following:
Upon any visible damage, the pertinent portions of the rack shall be
unloaded
immediately by the user until the damaged portion is repaired or replaced.
3. In the warehouse section of the business, one (1) steel storage rack
contained a partially corroded shelf. Refer to ANSI standard MH16.1
Paragraph 1.4.9.
4. In the warehouse area of the business, one (1) steel storage rack
contained a
sagging shelf. Refer to ANSI standard MH16.1 Paragraph 1.4.9.
ONE FEASIBLE MEANS OF ABATEMENT WOULD BE TO FOLLOW ANSI MH16.1
PARAGRAPH 1.4.2 (PLAQUES FOR LOAD CAPACITY) AND 1.4.9 (REPLACE ORREPAIR
DAMAGED PARTS).
