Nevada Revised Statute 618.375  Duties of employers. Every employer shall:
1. Furnish
employment and a place of employment which are free from recognized
hazards that are causing
or are likely to cause death or serious physical harm to his or her
employees.
- In the workshop and storage area of A2Z Motorsports, located at 7060
West Warm Springs
Road, Suite #130. Las Vegas, Nevada 89113.
1. On August 9, 2013, a racking system located near the East side of the
establishments shop area was being used to store approximately twenty
eight (28)
scooters weighing approximately 250 LBS each. There were also approximately
eight (8) pallets of miscellaneous helmets and parts being stored as well.
The
employer did not take the appropriate steps to insure the proper
installation and
use of the racking system as required by the ANSI MH16.1.
2. On August 9, 2013, a racking system located near the West side wall of
the
establishments shop area was being used to store approximately four (4)
scooter
weighing approximately 250 LBS each. There were also approximately three
(3)
pallets of helmets and one (1) pallet of motor oil stored on the racking
system.
The employer did not take the appropriate steps to insure the proper
installation
and use of the racking system as required by the ANSI MH16.1.

Section 1.4.2: Plaque. The owner is responsible for displaying in one for
more
conspicuous locations a permanent plaque(s). Each plaque shall have an
area of not less
that 50 square inches. Plaques shall show in clear, legible print (a) the
maximum
permissible unit load and/or maximum uniformly distributed load per level,
(b) the
average unit load if applicable and (c) maximum total load per bay. The
employer did
not ensured that the maximum load for the shelving units was legibly and
conspicuously
posted, leaving the potential for the shelves to become over loaded, which
may cause
them to collapse potentially leading to serious crushing injuries and/or
death.
Section 1.4.4: Load Application and Rack Configuration Drawings. Load
applications
and configuration drawings shall be furnished with each rack installation.
One copy
should be retained by the owner and another by the dealer or other local
rack
manufacturer representative for use by an inspecting body. Employer did
not have a copy
of the load application and configuration drawings, and could not provide
them to the
inspecting body; proper shelf configuration and/or loading could not be
established.
Section 1.4.7: Column Base Plates and Anchors. The bottom of all columns
shall be
furnished with column base plates, as specified in section 7.2. All rack
columns
shall be
anchored to the floor with anchor bolts capable of resisting the forces
caused by the
horizontal and vertical loads on the rack. The racks had not been anchored
to the
concrete floor by means of the provided base plates. Forces exerted on the
racks, eithervertical or horizontal, could cause the unit to tip, leading
to sever crushing injuries
and/or death.
Section 7.1.2: Beam Locking Device. Except for movable-shelf racks, beams
shall have
connection locking devices (or bolts) capable of resisting an upward force
of 1,000
pounds (453.6 kg) per connection without failure or disengagement. The
racks had not
been properly secured to the columns through means of locking devices or
bolts capable
of withstanding 1,000 pounds of upward force, leaving the possibility that
the powered
industrial truck may dislodge the rack. This could cause the rack to
collapse, in part or
in full, leading to serious crushing injuries and/or death.
ONE POSSIBLE MEANS OF ABATEMENT WOULD BE TO FOLLOW THE
DESIGN, INSTALLATION, AND UTILIZATION REQUIREMENTS SET FORTH IN
ANSI MH16.1 - 2004(R2008).
