Nevada Revised Statute 618.375(1): Duties of employers. Every employer shall furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. In the warehouse at Standard Equipment Company, steel storage racks were observed loaded with materials and being used by employees while they were damaged and not bolted to the floor. The steel storage racks had not been inspected and taken out of service as required by ANSI MH16.1:2008. The steel storage racks were between eleven (11) and twenty (20) feet tall, and in this condition will cause the steel storage racks to collapse or tip over, exposing employees to struck by and caught between hazards. 1. Five (5) steel storage racks throughout the warehouse were loaded with materials and bent or damaged and not taken out of service which is required by ANSI MH16.1:2008 1.4.9. 2. Fourteen (14) steel storage racks throughout the warehouse also loaded with materials were not anchored and secured to the ground to prevent tip over as required by ANSI MH16.1:2008 1.4.7. **** ANSI MH16.1:2008, 1.4.9 Rack Damage: "Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user until the damaged portion is repaired or replaced." **** ANSI MH16.1:2008, 1.4.7 Column Base Plates and Anchors: "All rack columns shall be anchored to the floor with anchor bolts capable of resisting the forces caused by the horizontal and vertical loads on the rack." One feasible means of abatement would be to repair or replace all damaged steel storage racks according to ANSI MH16.1:2008, 1.4.9 "Rack Damage". As well as anchoring the steel storage racks to the ground according to ANSI MH16.1:2008, 1.4.7 "Column Base Plates and Anchors".
