Nevada Revised Statute 618.375 Duties of employers. Every employer shall: Furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. At West Coast Arborist office located at 270 Commerce park court, North Las Vegas, Nevada 89032, the employer did not ensure the work place was free from recognized hazard as follows: On September 9, 2013, in the shope area 3/4"" polyvinyl chloride (PVC) pipe was used to transport compressed air from an air compressor unit to multiple locations in the shop. The air pressure in the PVC pipe operated at 150 psi. Employees worked in close proximity to the PVC pipe on a daily basis using the connection points to hook up pneumatic hand tools and used the compressed air to plow off tool. Employee were exposed to possible serious injury form the PVC pipe exploding, causing a shrapnel hazard. Reference: Letter of interpretation dated February 28, 1991. Subject: Using Thermoplastic Pipe in above ground locations. Since PVC material does not posses shatter resistant property, and since it is very clear from the industry's recognized practice that PVC pipes are prohibited for above ground transportation of compressed air and gases (unless the pipelines are encased in shatter resistant material), any such use by the employers, where employees may be exposed to hazards, will be in violation of Section 5(a)(1) of the OSH Act. Therefore, employers who are found to violate the above described conditions or manufacturer's recommendations, during an OSHA inspection, shall be issued a 5(a)(1) citation. One feasible means of abatement would be to use galvanized piping in lieu of PVC pipe.

Neveda Revised Statute 618.375(1): Duties of employers. Every employer shall: Furnish employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his or her employees. At West Coast Arborist work site located at 3545 Pueblo Way Las Vegas, Nevada 89169, the employer did not ensure the following processes were followed in accordance with ANSI Z133.1 - 1972 Safety requirements for tree pruning, trimming, repairing, or removal as follows: 4.1 General. All overhead and underground electrical conductors and all communications wires and cables shall be considered to be energized with potentially fatal voltages shall never be touched either directly or indirectly. On Septemeber 20, 2013 it was discovered through employee interviews and admission by the on duty Foreman, for West Coast Arborist, that hte Foreman instructed his employees to throw a rope over the communication lines in an effort to ascend to a level which would allow an employee to remove a branch that had become entangled in the high voltage lines. Employees were exposed to possible serious injury from an electocution hazard. One feasible means of abatement would be in implement a progressive disciplinary policy that will deter supervisors from breaking company policy.
