North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees operating and/or working near underhung hoists in that employees were exposed to struck by hazards: a)maintenance shop, where frequent and periodic inspections were not conducted to identify defects on the Budgit and Cyclone hoists. b)maintenance shop, where the rated load was not marked on the monorail for the Budgit hoist. Feasible and acceptable method to correct this hazard is to implement hoist inspections as outlined in ANSI: ASME B30.16-2007, Chapter 16-2 Inspections and Testing for Overhead Hoists (Underhung) Safety Standard and mark the rated load per ANSI: ASME B30.11-2010, Section 11-1.1.2, Marking the rated load on the monorail.
